As a result of 87 separate exclusion requests filed by the trade, the U.S. Trade Representative has granted a second group of product exclusions for certain goods under List 1 of the China Section 301 sanctions that will be published in the Federal Register on March 25, 2019. The first group of product exclusion was announced on December 28, 2018. These exclusions apply retroactively to July 6, 2018 which is the date when sanctions were first imposed and they will be in effect for one year from the date of their official announcement in the Federal Register. Goods must me properly classified under one of the approved Harmonized Tariff Schedule numbers listed below in order to qualify for the exclusion, even if the importer of record did not file a particular exclusion request.
(1) 8412.21.0045 – Hydraulic power engines and motors with linear acting telescopic cylinders
(2) 8430.31.0040 – Self-propelled rock breaking machines
(3) 8607.21.1000 – Rail air brakes and part thereof
